Terms of Service

These Terms of Service ("Terms") govern your use of the Cue application and related services (the "App"), provided by Motion by Maya ("Cue," "we," "us"). By downloading or using Cue, you agree to these Terms. If you do not agree, do not use the App.

1. Who can use Cue

You must be at least 18 years old (or the age of majority where you live) to use Cue. By using the App you represent that you meet this requirement and that the information you provide is accurate.

2. Your account

You may use Cue locally without an account. If you create one, you are responsible for keeping your login secure and for activity under your account. Notify us promptly of any unauthorized use.

3. Your content

You retain ownership of the classes, sequences, notes, reflections, and other content you create in Cue ("Your Content"). You grant us a limited license to store, process, and display Your Content solely to operate the App for you (for example, to sync it across your devices or to process an AI request you make). We do not claim ownership of Your Content and do not use it to train our own models.

4. AI features

Cue offers optional AI features that generate or transform class material. AI output is provided as suggestions only. It may be inaccurate, incomplete, or unsuitable for a given class or student. You are the professional in the room: you are solely responsible for reviewing, editing, and deciding whether and how to use any AI-generated sequence, cue, or modification.

Safety notice. Cue is a planning and teaching tool, not medical, fitness, or professional advice. You are responsible for the safety, suitability, and supervision of any class you teach, including sequencing appropriate to your students' abilities and any contraindications. Cue does not assess student health or readiness.

5. Acceptable use

You agree not to: use Cue for unlawful purposes; attempt to disrupt, reverse engineer, or gain unauthorized access to the App or its backend; abuse, overload, or attempt to circumvent usage limits of AI or other features; or upload content that infringes others' rights or violates law.

6. Plans, free tier, and subscriptions

Cue currently offers a free tier (with limits on saved classes and AI usage). We may introduce paid subscriptions in the future. If we do, pricing and terms will be presented before purchase, and any purchase will be processed by the applicable app store (Apple App Store or Google Play) under its terms, including renewal and cancellation rules. We may change features or limits over time.

7. Third-party services

Cue relies on third-party providers (including Supabase, OpenAI, Apple, Google, Spotify, and Sentry) and may link to third-party content. Your use of those services is subject to their terms, and we are not responsible for them. See our Privacy Policy for how data is shared.

8. Intellectual property

The App itself — including its software, design, branding, and the "Cue" name and logo — is owned by us and protected by law. These Terms do not grant you rights to our trademarks or to copy the App.

9. Disclaimers

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that AI output will be accurate or suitable.

10. Limitation of liability

To the maximum extent permitted by law, Cue and its providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or for any injury arising from classes you plan or teach using the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us in the 12 months before the claim, or USD $50.

11. Indemnification

You agree to indemnify and hold harmless Cue and its providers from claims arising out of your use of the App, Your Content, or your violation of these Terms or applicable law, including claims related to classes you teach.

12. Termination

You may stop using Cue and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the App or other users. Sections that by their nature should survive (ownership, disclaimers, liability, indemnity) will survive termination.

13. Governing law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in the State of New York, United States, unless applicable law requires otherwise.

14. Changes to these Terms

We may update these Terms from time to time. We will revise the "Last updated" date and, for material changes, provide notice in the App. Continued use after changes means you accept the updated Terms.
